Kotia case: Odisha seeks justice from Supreme Court

The Odisha government is seeking justice from the Supreme Court in the Kotia case. After the formation of the BJP government in Odisha and the Telugu Desam-led NDA government in Andhra Pradesh in the 2024 elections, it was expected to resolve the conflict through APOs talks at the political level. But on July 29, the Odisha government has filed an I.A. to amend the pending original suit in the Supreme Court in the Kotia case. The amendment petition signals the state’s BJP government’s efforts to seek justice through the courts in the crorepati case. In 2021 Andhra Pradesh Tristariya Panchayat Elections, conflict arose between Andhra and Odisha. The Andhra Pradesh government held elections in the Kotiya region with force despite the Supreme Court’s stay order. At that time, the Odisha government filed a contempt of court case against the Andhra Pradesh government in the Supreme Court, which is pending before the court. The Odisha government filed the original suit in the court in 2023 to abrogate Article 131 of the Indian Constitution, which is the main barrier to resolving the Kotia dispute.

In 2006, the Supreme Court heard the original suit filed by the Odisha government in 1968 to resolve the Kotia dispute. He pointed out that the original suit of the Odisha government related to the Kotia dispute was not justiciable under Article 131 of the Constitution. The court also noted that the Indian Parliament can resolve the issue by continuing the status quo in the Kotia region. The amendment petition filed by the Odisha government was listed for hearing on Monday in the bench of Supreme Court Justice Ujwal Bhuyan, but due to lack of time, it could not be heard. On the other hand, on August 1 this year, Koraput MP Saptagiri Ulaka presented a demand in the Lok Sabha for the Government of India to issue clear instructions to prevent the interference of the Andhra Pradesh government in the Kotia region. MP Ulaka pointed out that the Kotia area under Jaipur Garjat has been under the control of Odisha government since 1936. Andhra Pradesh was formed in 1955. The Odisha government approached the Supreme Court in 1968 against Andhra’s interference in the Kotia region. The court heard the case and held that the border disputes between the two states could be resolved by Parliament and ordered the status quo to be maintained in the Kotia region. However, due to repeated interference by Andhra Pradesh government in Kotia region, problems are arising.
